Disclaimer and Service Agreement
By purchasing any intuitive designs and artwork through C Real Solutions LLC ("Company"), operated by Chantelle Zapata ("Service Provider"), you ("Client") agree to the following legally binding Terms & Conditions. These terms govern all transactions related to intuitive graphic design services offered by the Company.
1. SCOPE OF SERVICE
(a) Service Provided
The Company agrees to provide intuitive graphic design services to the Client based on the selected package. The scope of services includes the creation of unique, custom-designed graphics for branding, marketing, and promotional materials.
(b) Available Packages
- The Growth Design Retainer: One (1) custom-designed graphic.
- The Essential Design Retainer: Three (3) custom-designed graphics.
These graphics will be created based on the Client’s specifications, branding preferences, and any additional content provided.
(c) Client Responsibilities
To begin the design process, the Client must:
- Complete an intake form with clear reference images, branding preferences, and any specific design concepts or elements required.
- Provide all necessary materials for the design, including logos, color palettes, and any other visual content that will inform the design process.
(d) Limitations of Service
The Company reserves the right to make reasonable adjustments to the scope of services if necessary to ensure the quality of the final designs
The Growth Design Retainer
1. Scope of Work
- The Designer agrees to provide 1 custom graphic per month.
- 2 reformatted sizes per design (delivered after final approval).
- 2 rounds of edits per design.
- The original design will be delivered within 3-4 days.
- Edits take 24-48 hours per round.
- Canva file access will be provided after final approval.
2. Payment & Commitment
- $397/month (or $247/month for a 3-month commitment).
- Payments must be made in full before any design work begins.
- No rollovers for unused designs except for 3-month commitments.
- Unused designs must be used within 1 month or they expire.
3. Revision Policy
- Up to 2 rounds of edits per design are included.
- Edits beyond the included rounds are charged:
- $50 per additional round.
- $75 per major redesign (e.g., complete layout overhaul, major content changes).
- Once a design is approved, any further changes will be billed as a new design.
The Essential Design Retainer
1. Scope of Work
- The Designer agrees to provide 3 custom graphics per month.
- 3 reformatted sizes per design (delivered after final approval).
- 3 rounds of edits per design.
- The original design will be delivered within 3-4 days.
- Edits take 24-48 hours per round.
- Canva file access will be provided after final approval.
2. Payment & Commitment
- $1,597/month (or $990/month for a 3-month commitment).
- Payments must be made in full before any design work begins.
- Unused designs must be used within 1 month or they expire.
3. Revision Policy
- Up to 3 rounds of edits per design are included.
- Edits beyond the included rounds are charged:
- $50 per additional round.
- $75 per major redesign (e.g., complete layout overhaul, major content changes).
- Once a design is approved, any further changes will be billed as a new design.
- Minor revisions include:
- Color adjustments
- Text changes
- Slight layout tweaks
- Major revisions (treated as a new design) include:
- Layout overhauls
- New images
- New design direction
- Additional sections
Additional Terms (Applicable to All Packages)
1. Approval & Revision Process: Once a design is approved and edits are finalized, any new requested changes will be billed as a new design.
3. Rollover Policy:
- The Growth Retainer: No rollovers (except for 3-month commitments).
- The Essential Retainer: Unused designs must be used within 1 month.
2. PAYMENT AND REFUND POLICY
(a) Payment Terms
Full payment is required at the time of booking. No services will be rendered until payment is received. By making payment, the Client acknowledges and agrees to the terms outlined in this Agreement and Disclaimer.
(b) Refunds and Exceptions
All payments are final and non-refundable, except in the case of accidental over-purchase. If a Client accidentally orders multiple quantities of a product or service, a written request for a refund must be submitted within 48 hours of purchase. No other circumstances will warrant a refund. Chantelle Zapata reserves the exclusive right to deny any request for a refund.
(c) Cancellation and Delays
Failure to engage with the design process (e.g., not responding to revision requests or missing deadlines) may delay the delivery of the final graphics. If the Client does not engage for 7 days after the graphics are delivered, the project will be considered final and complete.
3. DELIVERY TIMELINE AND REVISIONS
(a) Delivery Timeframe
The Company will deliver the graphics within the following timeframes:
- The Growth Design Retainer: Delivery within 2-3 business days after the initial call.
- The Essential Design Retainer: Delivery within 2-3 business days after the initial call.
(b) Revision Process
The Client is entitled to revisions within the following parameters:
- The Growth Design Retainer: Up to two (2) revision rounds.
- The Essential Design Retainer: Up to two (2) revision rounds per graphic.
Revisions should be submitted within 24-48 hours of receiving the initial design. If the Client fails to provide feedback within this timeframe, it may delay the final delivery of the graphics.
(c) Final Approval
If the Client does not engage in feedback or revisions within 7 days of receiving the designs, the project will be considered complete and final.
4. INTELLECTUAL PROPERTY AND USAGE RIGHTS
(a) Client's Usage Rights
Upon full payment and final delivery, the Client receives full rights to use the delivered graphics for any business purpose, including but not limited to marketing, branding, promotional materials, and commercial use. The Client may use the designs for their offers, programs, products, services, and brand promotion.
(b) Company's Usage Rights
The Company retains the right to use the delivered graphics for promotional purposes and marketing, including showcasing the designs in the Company’s portfolio, website, social media, and other promotional materials.
(c) Resale and Redistribution
Digital products, including templates, PDFs, E-books, or any non-customized offerings, are not available for resale. Custom-designed graphics may only be used for the Client’s personal or business marketing and promotional purposes and cannot be sublicensed or sold to third parties without prior written consent from the Company.
(d) Exclusivity
The Client’s personal branding or specific identifiable elements will not be used in public materials by the Company without prior written consent. If the Client desires exclusivity of all custom-designed graphics, a separate licensing agreement may be required.
5. DISCLAIMERS AND LIMITATION OF LIABILITY
(a) Creative Nature of Services
The Client understands that graphic design is a creative service, and results are subjective. While the Company strives to meet the Client’s expectations, the Client acknowledges that no guarantees can be made regarding the exact replication of design concepts or desired outcomes.
(b) Limitations of Design Technology
The Company makes no warranties regarding:
- The precise replication of any specific design feature or concept.
- The Company’s ability to generate complex or intricate patterns (e.g., detailed logos, patterns).
(c) Liability
The Company shall not be held liable for:
- Any dissatisfaction with the final designs or the creative process.
- Financial or reputational losses arising from the use or perceived impact of the delivered graphics.
The Client releases the Company from any and all claims, demands, and liabilities related to the accuracy, appearance, or final result of the designs.
6. GOVERNING LAW AND DISPUTE RESOLUTION
(a) Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas, USA.
(b) Dispute Resolution
If any dispute arises under this Agreement, the Parties agree to attempt to resolve it through good-faith negotiations. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration conducted virtually.
(c) Arbitration and Attorney’s Fees
The prevailing party in any arbitration shall be entitled to recover reasonable attorney’s fees and costs.
(d) Public Disparagement
The Client agrees not to publicly disparage the Company on social media, review platforms, or any public forum during the dispute resolution process.
7. ACCEPTANCE OF TERMS
By making payment for the services, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions and the Disclaimer outlined in this Agreement. Payment constitutes acceptance of this agreement and the terms set forth herein.
Disclaimer for All Offerings
All buyers are advised to perform their own due diligence regarding the applicability and suitability of the products and services offered through C Real Solutions LLC and Chantelle Zapata at www.chantelle-zapata.com. These offerings include, but are not limited to, energy-activated portraits, done-for-you templates, PDFs, E-books, workbooks, online group containers, 1:1 consulting, and intuitive graphic design services.

All buyers must exercise independent judgment and discretion when using the content and should seek independent professional advice if necessary. Refund Policy: All sales are final, and no refunds are guaranteed. Any request for a refund will be reviewed at the sole discretion of Chantelle Zapata. She reserves the right, at her free choice, to determine whether a partial or full refund may be granted in exceptional circumstances, for example, accidentally purchasing multiple quantities of a digital product or service. Client dissatisfaction based on artistic expression is not warranted as a valid reason for a refund. Clients who respond in an untimely fashion or who take longer than 48hrs to respond for editing and revision rounds, delay their own timeline for deliverables. If a client fails to engage or respond for an entire week before the agreed delivery date, graphics will be considered final and approved. By purchasing any product or service, the buyer acknowledges and agrees to this policy.
